By accessing or using Hearth ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Hearth is a communication accessibility platform designed for deaf and non-speaking individuals. The Service provides speech-to-text transcription, text-to-speech output, phone calling, and SMS messaging capabilities. Hearth is designed to facilitate communication and is not a substitute for emergency services.

3. Account Registration

• You must be at least 13 years old to create an account
• If you are between 13 and 17 years old, you must have a parent or legal guardian who agrees to these Terms on your behalf and who is responsible for your use of the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account

4. SMS Messaging

By providing your phone number and creating an account, you consent to receive SMS messages through the Hearth platform. This includes:

• Messages relayed between you and your contacts
• Service notifications and account alerts

You may opt out of SMS messaging at any time by replying STOP to any message. Reply START to resume messaging. Message and data rates may apply. Message frequency varies based on usage.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, threaten, or intimidate any person
• Send spam, unsolicited messages, or bulk communications
• Impersonate another person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service or its systems

6. Phone Number

If your subscription plan includes a dedicated phone number, that number is provided through our telecommunications partner and remains the property of Hearth. If you cancel your subscription, you may request to port your number to another provider, subject to applicable regulations and fees.

7. Subscription and Billing

Certain features of Hearth require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

8. Limitation of Liability

Hearth is provided "as is" without warranties of any kind. We do not guarantee the accuracy of speech-to-text transcriptions or the uninterrupted availability of the Service. Hearth is not a replacement for emergency communication services. In no event shall Hearth be liable for any indirect, incidental, special, or consequential damages.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that is harmful to other users or the Service. You may delete your account at any time through your account settings.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
